Basic Estate Planning

A common misconception about estate planning is that you don’t need it if you don’t have much to pass on when you die. That may seem logical, especially for the young and healthy. However, regardless of health or wealth, dying without basic planning can leave your loved ones with major problems to solve.

Advanced Estate Planning (including Asset Protection)

While a basic estate plan can avoid a variety of problems when you die or lose capacity, there are many things it does not do. Parents with children under 30, mixed family, total assets over $100,000, limitations on distributions, beneficiaries with disabilities, etc.—any one of these things can be a reason to consider a more robust estate plan including a trust. Incorporating a trust into your estate plan can also add asset protection for you and for your beneficiaries.

Estate Administration (Probate and Trust Administration)

It’s an honor to be trusted by someone enough to be asked to administer their estate. It can also be overwhelming. Funeral arrangements, organizing records, sending notifications, preparing accountings, distributing assets, etc.—it’s a juggling act even in simple cases. Heirs and Beneficiaries

In some cases, heirs and beneficiaries (collectively “beneficiaries”) become concerned about whether the person administering the estate is acting according to the intentions of the deceased person and laws of the state. Ideally, the beneficiaries can communicate their concerns with the person in charge and get clear answers, but that is not always the case. As a beneficiary, you have rights, including the right to be informed about anything that might impact your interests.

Expert and Impartial Trustee, Personal Representative

The duties of trustees and personal representatives are similar in that they are charged with taking control of a decedent’s property for the purpose of distributing assets to beneficiaries or heirs. Both trustees and personal representatives are answerable for actions relative to the estate. They are required to communicate with heirs, pay debts and distribute assets as set forth in a will or trust. The complexity of the duties will depend upon the size and type of assets of the estate. The trustee/personal representative must be fair and impartial, and loyal to the will of the decedent. Because of the importance of handling an estate in compliance with all state and federal laws, we offer Personal Representative and Trustee Services.

Guardianships and Conservatorships

Guardianship and conservatorship are terms used for court-appointed authority to make financial, health care or other life decisions for an incompetent or incapacitated person. A guardian is responsible for personal and health-related matters of the “ward” whereas a conservator manages the financial affairs. The ward could be a minor or an adult with a disability who is unable to make decisions. The law permits a person, an organization or corporation to serve as guardian or conservator.
