Heirs and Beneficiaries

In estate law, a beneficiary is someone designated to receive a distribution under a will or a trust, while an heir is someone who receives a distribution under state laws from those who pass away without a will or trust. For simplicity, we will refer to heirs and beneficiaries collectively as “beneficiaries.”

Beneficiaries have rights under the laws of the state and, if applicable, under the terms of the will or trust. For example, beneficiaries have the right to know about the assets of the estate, the liabilities of the estate, as well as what income is received and what expenses are paid. Beneficiaries also have the right to be kept reasonably informed about any action the estate administrator takes that may impact the interests of the beneficiaries. An estate administrator must act in the interest of the beneficiaries in carrying out the terms of the trust or will and must not favor one beneficiary over another.
